1. Applicability and General Provisions

These Terms apply to all orders placed through the Website by consumers. Separate terms apply to business-to-business (B2B) sales.

You confirm that you are at least 18 years old and have full legal capacity to enter into contracts.

We may refuse access to the Website or cancel orders for legitimate reasons (e.g., suspected fraud or unavailability).

Distance sales are subject to Portuguese consumer protection laws, in particular Decree-Law No. 24/2014 (distance contracts) and Decree-Law No. 84/2021 (guarantees in the sale of consumer goods).

2. Seller Identity and Information Obligations

For each vehicle, we provide mandatory information: make, model, year, verified mileage, fuel type, colour, equipment, CO2 emissions, history, and any recalls or inspections.

Prices include VAT and all applicable costs unless stated otherwise.

3. Offers and Vehicle Descriptions

3.1 Vehicle Descriptions

Specifications are based on data from suppliers and manufacturers. We strive for maximum accuracy but cannot guarantee complete absence of errors. We recommend a personal inspection or independent appraisal before purchase.

3.2 Availability

Offers are subject to stock. If a vehicle becomes unavailable after order confirmation, we will inform you immediately and fully refund any amounts paid.

3.3 Promotions and Prices

Promotions or discounts refer to the lowest price applied in the previous 30 days.

4. Order Process

4.1 Selection and Ordering

You can browse, add items to the cart, and proceed to checkout.

4.2 Confirmation

Review all details (price, taxes, delivery) before finalising.

4.3 Binding Nature

The order becomes binding upon full payment. We reserve the right to cancel in cases of obvious pricing errors, suspected fraud, or unavailability.

5. Price and Payment

5.1 Prices

Displayed in euros (€), including VAT and indicated costs.

5.2 Payment Methods

We accept credit/debit cards, bank transfers, or financing through approved partners. Payments are processed by certified and secure entities. Full payment is required before delivery.

5.3 Legal Limits

Cash payments are limited to amounts below €3,000 per transaction, in accordance with Portuguese anti-money laundering legislation.

5.4 Non-Payment

In case of delay, statutory interest and reasonable administrative costs will apply.

6. Delivery and Transport

6.1 Delivery Time

Estimated at 3 to 15 working days, depending on origin and logistics.

6.2 Transport

Home delivery by professional carrier (costs €500–€2,000 depending on distance). Collection possible in Guarda by prior agreement. With or without matrícula/ISV.

6.3 Transfer of Risk

Risk transfers upon physical delivery. Visible damage must be noted immediately on the consignment note (CMR for international transport).

6.4 Delays

We are not liable for force majeure. We will inform you of any delays.

6.5 Documents on Delivery

You will receive all necessary documents: certificate of conformity, manual, and keys.

7. Right of Withdrawal

Under Decree-Law No. 24/2014, you have the right to withdraw from the contract without reason within 14 days from receipt of the vehicle (except customised vehicles).

To exercise this right, notify us by unequivocal statement (email or letter). You must return the vehicle in good condition, without excessive use beyond what is necessary for testing.

Direct return costs are borne by the consumer. We may deduct loss of value due to excessive use. We will refund the purchase price within 14 days of receiving the vehicle.

8. Warranties and Conformity

8.1 Legal Warranty

Rules of Decree-Law No. 84/2021 apply: 3-year conformity warranty (may be reduced by written agreement to a minimum of 18 months for used vehicles). Lack of conformity is presumed in the first 12 months.

Report defects within 2 months of discovery. You are entitled to free repair, replacement, price reduction, or contract termination.

8.2 Manufacturer Warranty

Automatically transferred if applicable (2–7 years depending on brand).

8.3 Additional Commercial Warranty

We offer a minimum 1-year commercial warranty on used vehicles, in addition to the legal one.

8.4 Liability Limitations

Liability limited to the purchase price, except in cases of intent or gross negligence. No liability for indirect damages.

8.5 Transport Damage

Governed by the CMR Convention; liability lies with the independent carrier.

9. Intellectual Property

All Website content is owned by ReadyCar ® or its licensors. Reproduction without authorisation is prohibited.

10. User Conduct

Illegal, fraudulent, or harmful use is prohibited. We may suspend access and report violations to authorities.

11. Privacy

Your data is processed in accordance with our Privacy Policy and the GDPR.

12. Applicable Law and Dispute Resolution

Governed by Portuguese law. In case of dispute, we will attempt amicable resolution. You may use the European Online Dispute Resolution platform (ODR): https://ec.europa.eu/odr or authorised consumer arbitration centres (list at https://www.dgpj.justica.gov.pt ). Portuguese courts have jurisdiction, with preference for the consumer's domicile.

13. Force Majeure

We are not liable for non-performance due to unforeseeable and unavoidable circumstances beyond our control.
